Welcome to TipGator, a platform that allows service providers—such as servers, entertainers, guides, and gig workers—to share their preferred payment links with customers for tip collection. These Terms of Service (“Terms”) govern your use of TipGator (“the Service,” “we,” “our,” “us”). By creating an account or using the Service, you agree to these Terms.

1. Description of Service

TipGator allows you to display and share your preferred digital payment links (e.g., Venmo, Cash App, Zelle, PayPal, and custom URLs). TipGator does not process payments, hold funds, or connect directly to your payment provider accounts. All transactions occur solely between you and your customers through your chosen payment platforms.

2. Eligibility

You must be at least 18 years old and legally able to enter into contracts to use the Service.

3. Account Responsibilities

You are responsible for maintaining the security of your account and login credentials. You must provide accurate information and keep it up to date. You are responsible for the content you upload, including payment links, profile details, and any media such as images or logos. It is your responsibility to ensure that your payment links are correct. You are encouraged to check your payment links periodically. TipGator and Ray Of Light Media will not be liable for incorrect payment links.

4. Subscription Fees & Billing

TipGator is a recurring monthly subscription service. All fees are billed automatically through our payment provider (Stripe). No refunds are provided for any reason, including cancellation, unused time, or failure to use the Service. You may cancel your subscription at any time; cancellation prevents future billing but does not issue refunds.

5. User Content

You grant TipGator a non-exclusive license to display content you submit (such as your name, greeting, profile photo, and payment links) solely for the purpose of delivering the Service. You agree not to upload illegal, fraudulent, harmful, or misleading content.

6. Service Availability

We strive to provide continuous availability, but we do not guarantee uninterrupted service. Maintenance, server issues, or outages may occur.

7. No Financial Liability

TipGator is not a fiduciary agency. We do not collect or distribute funds. We simply are a means for you to conveniently provide your guests with your third party payment links.

Since TipGator does not handle or process any payments: We are not liable for customer disputes, We are not liable for payment provider outages or issues, We are not liable for delays, failed payments, fraud, or chargebacks. You acknowledge that payment activity is entirely handled by your selected third-party platforms.

8. Limitation of Liability

To the fullest extent permitted by law: TipGator is not liable for any indirect, incidental, or consequential damages. Our total liability for any claim is strictly limited to an amount equal to one (1) month of your subscription fee, regardless of the cause of the claim. This limitation applies even if we were advised of the possibility of such damages.

9. Termination

We may suspend or terminate accounts that violate these Terms, include fraudulent payment links, or engage in harmful activity. You may cancel your subscription at any time.

10. Modification of Terms

We may update these Terms periodically. Continued use of the Service indicates acceptance of the updated Terms.
